This is the complete terms and conditions agreement that apply to any company, corporation, or individual participating in
          the Promo Tees and Designs AFFILIATE "Program". For the purpose of this Agreement, "Affiliate" means the applicant.

The terms of this agreement shall commence on the date an approved Affiliate places an approved link to Promo Tees and Designs' site.  Upon (48 hours) 2 days written notice from either the AFFILIATE or Promo Tees and Designs sent via email, mail or fax mail  540-548-2445 this agreement will be considered terminated.  Upon termination, AFFILIATE agrees to remove ALL Link(s) to Promo Tees and Designs site from the AFFILIATE's site.

Promo Tees and Designs has the right to determine which sites qualify for participation in their program.  Commericial and Non-Profit sites are welcomed however, it is at Promo Tees and Designs' sole discretion to accept or deny participation in the Promo Tees and Designs Affiliate Program.

Promo Tees and Designs will supply AFFILIATE with graphical image and text to be placed on AFFILIATE's site.  It will act as a link to refer visitors to Promo Tees and Designs' site. You the AFFILIATE can submit alternate artwork to Promo Tees and Designs for approval.

Promo Tees and Designs will compensate AFFILIATE for each AFFILIATE "Referred Purchase". An AFFLIATE "Referred Purchase" is defined as a purchase made during a user session whereby the visitor used the AFFILIATE’s unique assigned URL to gain access to Promo Tees and Designs’s site.

"Purchase Amount" is considered the gross amount of an AFFILIATE Referred Purchase after discounts but minus sales tax and shipping charges.

AFFILIATE Referred Purchases will be solely determined by the log file reports of Promo Tees and Designs. AFFILIATE will have access to sales and traffic reports 24-hour a day via a provided URL disclosed in the approval "Confirmation Letter" emailed to the AFFILIATE.

Promo Tees and Designs will remit to AFFILIATE 10% of the Purchase Amount of AFFILIATE Referred Purchases as defined in # 4 above.

Payments will be made on a quarterly basis within 30 days after the end of the quarter.  We will only remit payments which total $20.00 or more.  Payments due AFFILIATE in any quarter that is less than this amount will be carried over to the next quarter.  All payments will be made in USA dollars.

AFFILIATE agrees to place a graphical link on their site referring visitors to Promo Tees and Designs'.  The graphical link must be one provided by Promo Tees and Designs or Approved by Promo Tees and Designs if it is created by the AFFILIATE.  AFFILIATE will include the code supplied by Promo Tees and Designs which contains the AFFILIATE's unique URL.

The AFFILIATE is responsible for paying any and ALL State, Local or Federal taxes due on the commissions earned.

AFFILIATE will within 30 days of being approved send in a signed and dated copy of this agreement before any payments will be disperse.

AFFILIATE will be able to earn commissions as soon as AFFILIATE receives the approval confirmation letter via email and places the appropriate code on AFFILIATE's site.  FAILURE by AFFILIATE to send us a signed and dated copy of this agreement by US mail or by fax to 540-548-2445 forfeits any commissions earned and membership in the program will be cancelled.

AFFLIATE may re-apply for participation in the Affiliates Program however, AFFLIATE understand that AFFILIATE "will not" be compensated for any commissions forfeited due to failure to send in the signed and dated agreement within the time specified.

 At any time Promo Tees and Designs may modify any of the terms and conditions contained in this Agreement by either emailing the revised agreement to the AFFILIATE or sending it by U.S. Mail.  If the AFFILIATE finds the modification(s) unacceptable, your only recourse will be to terminate your participation in the Program. An AFFILIATE continued participation in the Program after receipt of a revised agreement constitutes the AFFILIATE acceptance of the new agreement.  Promo Tees and Designs cannot be held responsible if you do not receive a copy of any revisions due to not informing us of changes to your email address or mailing address.

The laws of the United States and the State of Delaware will govern this Agreement. All action relating to this Agreement must be brought before the federal or state courts located in Wilmington, Delaware and you irrevocably consent to the jurisdiction of such courts.
